Liability for content

As a service provider we are responsible for our own content on these pages under general law pursuant to § 7(1) TMG. Under §§ 8 to 10 TMG, however, we are not obliged as a service provider to monitor transmitted or stored third-party information or to investigate circumstances indicating unlawful activity.

Obligations to remove or block the use of information under general law remain unaffected. Liability in this respect is, however, only possible from the point in time at which a concrete infringement becomes known. If we become aware of such infringements, we will remove the content in question immediately.

Information about the golf courses

Master data, tee distances, course and slope ratings, facilities and contact details of the 17 courses are maintained to the best of our knowledge, but are largely based on information provided by the clubs and may change without any involvement on our part. We accept no warranty for their accuracy, completeness or timeliness.

Only the information given by the respective club is binding. Tee times, green fees, handicap requirements and tournament dates are not part of the app; we do not broker bookings and are not a contractual partner of any golf club. Anyone planning a round should clarify these points with the club beforehand. Further details are set out in §8 of the Terms & Conditions.

Content posted by users

Ratings, comments and notes on rounds are posted exclusively by the users themselves and reflect their personal opinion, not that of the provider. This constitutes third-party information within the meaning of §§ 8 to 10 TMG; no review of the content takes place before publication, nor could this reasonably be expected of us. Responsibility for such content lies solely with the account that posted it. If we become aware of a specific infringement, we will remove the content concerned immediately and, where necessary, block the account.

Use on the course

Using the app while playing is at your own responsibility. The course rules, etiquette and safety instructions of the respective club always take precedence over the use of the app. We accept no liability for damage arising from inattentive operation of the device on the course.

Your own rounds and data backup

Without a signed-in account, favourites and scorecards are held on the device only and are not backed up on our server; they are lost if the app is removed or the local storage is cleared. Users are responsible for backing up their own rounds themselves. We accept no warranty for the permanent availability of locally stored data.

Advertising

In the free tier, advertising banners are displayed via Google AdMob. We have no influence on the selection of individual adverts; the respective advertiser is responsible for the offer advertised and for the content of the linked pages. Which data is processed in the course of this is set out in the Privacy Policy.

Liability for links

Our offering contains links to external websites of third parties over whose content we have no influence. We therefore cannot accept any responsibility for this third-party content. The respective provider or operator of the pages is always responsible for the content of the linked pages. The linked pages were checked for possible legal infringements at the time of linking; unlawful content was not discernible at that time.

Permanent monitoring of the content of the linked pages is not reasonable without concrete indications of an infringement. If infringements become known, we will remove such links immediately. The same applies to links that users place in their own content.

The content and works created by the site operators on these pages are subject to copyright law. Reproduction, editing, distribution and any kind of exploitation outside the limits of copyright require the written consent of the respective author or creator. Downloads and copies of this page are permitted for private, non-commercial use only.

Insofar as the content on this page was not created by the operator, the copyrights of third parties are respected. In particular, third-party content is identified as such. Should you nevertheless become aware of a copyright infringement, please let us know. If infringements become known, we will remove such content immediately.

Availability

We endeavour to keep the service available at all times but do not owe this. Maintenance work, technical faults and events beyond our control may lead to temporary restrictions. Details are set out in the sections “Availability & changes” and “Liability” of the Terms.
